Claiming for an accident while on holiday in the UK

Photo of a Welsh coastlineWith certain travel restrictions and a decreased appetite for traveling abroad, the country is likely to see more Britons choosing to explore areas of the UK for the rest of this year and the foreseeable future.

Various restrictions and regulations means that places that offer accommodation, such as hotels, campsites and caravan parks all need to ensure they comply to keep the risk of the Coronavirus spreading to a minimum. Coupled with an expected increasing number of visitors, the likelihood is that UK holiday destinations won't be in the best position to meed the demand. What's more, with tourist locations and facilities putting extra focus on the demands of social distancing measures and the like, it could mean other areas being overlooked, such as general maintenance or other health and safety issues.

Tourist and leisure sites have a duty of care to ensure visitors remain safe and that onsite facilities are free from defect or from causing a risk of harm. If these standards aren't met and somebody suffers an injury because of that, it may mean entitlement to a compensation claim.

What should you do if you are injured while on holiday in the UK?

The first thing you should be aware of is that if you are unfortunate enough to suffer an injury while on holiday in the UK, you have three years from the date of the accident to make your claim. It's a good idea to ensure the hotel, campsite, caravan park or wherever it is that you're staying accurately documents the accident in their accident report book. If possible, document the injury yourself as well with photographs where possible of any visible injuries along with any defects that caused the accident to take place in the first place.

If you would then like to pursue a personal injury claim you should speak to a legal team who specialises in personal injury cases at the earliest opportunity. They will be able to discuss your accident in detail with you and advise on whether or not you have a case for claiming compensation. The holiday destination where you suffered the injury should have a policy of liability insurance in place which would indemnify them against this sort of claim.

Accidents that take place here in the UK are generally a lot easier to deal with from a legal perspective as all UK regulations apply.
