Is my employer to blame for my accident at work?

Injured person after accidentTrying to escape suffering an accident throughout your entire life would take some doing so unfortunately most of us find ourselves involved in one or several accidents over the years. Accidents are happening every hour of every day and they are happening all around us. They are taking place on the road, while we're casually out shopping, as we walk down the street, when we're doing something at home and also while we're busy at work. Thankfully, not all accidents results in nasty injuries and many are just minor, but many other victims aren't quite so lucky. For those that are not so lucky, the injured victim may have a right to claim compensation if they were not at fault for the accident.

Many times a victim of an accident will contact us out of curiosity, often unsure whether it would be worth their time and effort to put forward a personal injury compensation claim. It should be stressed that if the accident was not your fault, then there are many positives that can come from doing so - with the main advantages being access to rehabilitation and financial compensation for the inconvenience caused and financial losses incurred.

Furthermore, clients are also often unaware that they may be able to bring a claim against their employers for accidents that occur at work, with this sometimes involving a claim against your employer's insurer. Of course, we respect that this can often seem like an awkward or difficult decision to make, especially if your employers have been particularly good to you over the years and provided you with plenty of opportunities. However, most sensible employers will be well positioned to deal with these sorts of issues sensitively and it's exactly why liability insurance is in place.

An employer liability claim

All employers have a legal responsibility to ensure their employees are safe at all times, including both a safe place to work and a safe system of work for them to follow. If you're someone who has suffered an accident in the workplace within the last three years, or if your health has deteriorated as a result of where you work, then you may be in a strong position to make a claim and we'd recommend you contact us to discuss your situation in more detail.

An employer liability claim is often referred to as a “work accident” claim, and they can range from things such as an employee accidentally tripping or slipping over on something that shouldn't be there, to an employee suffering injury as a cause of inadequate training being provided or because of a fault with machinery/equipment or the system that's followed for the role. Another example may be due to an employer's failure to provide suitable Personal Protective Equipment (PPE) for the job at hand, failing to conduct a risk assessment before an employee carries out a task or a failure to provide adequate monitoring or supervision of the workforce.
